A man charged with a serious assault in Donegal is to be sent forward to the Circuit Court.
John McDonagh appeared before Ballyshannon District Court charged with assaulting a man and causing him harm on October 14, 2024 at Railway Park, Donegal Town.
A 26-year-old, also with an address at Railway Park, Donegal Town, McDonagh was charged by Gardai and brought before the court.
The charge is contrary to section 3 (1) and 3 (2) of the Non-Fatal Offences Against The Person Act, 1997 as amended by section 20 of the Criminal Justice (Miscellaneous Provisions) Act, 2023.
McDonagh made no reply when cautioned. The court was told that the Director of Public Prosecutions (DPP) has directed that the matter be prosecuted on indictment in the Circuit Court. The DPP also consented for the accused to go forward on a signed guilty plea.
The case was adjourned to January to allow for the service of a book of evidence.
Judge Éiteáin Cunningham granted bail on condition that McDonagh have no contact, either directly or indirectly, with the alleged injured party or any witnesses in the case.
He must commit no further offence and be of good behaviour and to be available 24/7 for contact by Gardai on a mobile phone.
