Leitrim man applies to Letterkenny court to have car returned

A LEITRIM man appeared before Letterkenny District Court to seek the return of his car, which had been seized following a dangerous driving stop.

Sergeant Jim Collins told the court that Gabriel Mercer, of Dromahair, Co Leitrim, was stopped at Meencarrigagh, Ballybofey, on May 20 for dangerous driving. Sergeant Collins confirmed that Mercer was the driver of the vehicle.

The car was seized under section 109(a) of the Road Traffic Act 1961. Under this provision, gardaí may seize a vehicle where its use appears to constitute an offence such as dangerous or careless driving, and an application for its return must then be made to a judge of the District Court, who may impose conditions before releasing the vehicle.

Appearing before Judge Emile Daly, Mercer was asked if he agreed not to drive the car unlawfully, or to permit anyone else to drive it unlawfully. Mercer agreed, and the vehicle was ordered to be returned to him.
