Daniel Kavanagh (48), with addresses at 9 Cloncollig, Tullamore and 6 Kishogue Park, Dublin is alleged to have discharged a firearm, being reckless as to whether any person was injured or not, at 37 Kearney Drive, Tullamore on two separate occasions, February 28 last and June 4 last.

On both occasions he is also charged with possession of a firearm with intent to endanger life or cause serious injury to property.

Mr Kavanagh is on bail and when he appeared before Tullamore District Court a book of evidence was served on him by Garda Stacey O'Brien.

'He's on cloud nine' - Shane Lowry makes Toy Show kid's dream come true at Irish Open Garda O'Brien told the court the DPP consented to him being sent forward to the Circuit Court sitting on November 17 next.

The DPP had directed he be sent to the Circuit Court instead of the Central Criminal Court, the garda said.

Mr Kavanagh told the court the solicitor representing him, Aonghus McCarthy, was “on strike”.

Judge Andrew Cody replied: “This court isn't on strike. Why isn't he here?”

After giving the accused a warning about reporting an alibi in relation to the alleged offences, if he had an alibi, Judge Cody said: “It's imperative that you talk to Mr McCarthy immediately.”

The judge said he should speak to the solicitor about both the issue of an alibi and if he wished to be sent forward on a signed plea.

The latter option was permitted by the DPP, the court heard.
