Conspiracy case sparks legal debate

A COMPLEX case of alleged drugs charges and conspiracy sparked debate among legal fraternity this week.

Three men were served with the Book of Evidence at Letterkenny District Court on Monday.

Garda Pauline Doherty served the Book of Evidence for conspiracy on Christopher Doherty (36), of Baile na Carraig, Buncrana.

The alleged offence occurred on dates between December 5, 2024 and various dates up to April 1, 2025 at various locations within the State.

Sergeant Jim Collins said the Director of Public Prosecution (DPP) has consented to the case being sent forward for trial to the next sitting of Letterkenny Circuit Court, commencing on May 5.

However, defence solicitor Mr Frank Dorrrian said that the Book of Evidence was inadequate in that it “did not contain interviews of his client or anyone else’s”.

Responding, Sergeant Collins said: “Electronic methods will be used to furnish interviews today.”

Mr Dorrian contended that the conspiracy charges were complex. He said that even if the DPP had provided the recorded interviews of the alleged conspirators to him electronically that day, he would need more time to examine them.

He requested an adjournment until May 25 to Letterkenny District Court, to receive the interviews of the other parties in the Book of Evidence and consider them.

Alleged co-conspirator Patrick McGinty (39), of Carrickmagrath, Ballybofey, was served with the Book of Evidence at 11.27am on Monday.

McGinty (39) is charged with conspiracy contrary to section 71 of the Criminal Justice Act on December 5, 2024 and April 1, 2025, at various locations within the State.

He is also charged with being in possession of drugs worth €13,000 or more for the purpose of sale or supply on April 1, 2025 at Carrickmagrath, Ballybofey.

He is further charged with being in possession of cannabis for his own use, and offences regarding the fraudulent alteration or misuse of prescriptions for controlled drugs, on dates on dates between March 20, 2025 and April 1, 2025, at various locations within the State.

McGinty was sent forward for trial by Sergeant Jim Collins on the direction of the Director of Public Prosecutions to the next sitting of Letterkenny Circuit Court, commencing on May 5.

Defence solicitor Mr Patsy Gallagher requested legal aid and one junior and one senior counsel in the case.

Michael McGinty (32) of Carrickmagrath, Ballybofey, is charged with being in possession of drugs worth €13,000 or more for the purpose of sale or supply on April 1, 2025 at Carrickmagrath, Ballybofey.

Sergeant Jim Collins sent McGinty’s (32) case forward to trial at the next available sitting of Letterkenny Circuit Court on May 5.

Defence solicitor Mr Rory O’Brien agreed with Mr Dorrian that the Book of Evidence, served without exhibits was wrong.

Mr O’Brien requested one junior and one senior counsel in the case. He requested that summary matters be dealt with on September 7, 2026.
