A Letterkenny couple had the Probation Act applied when their case was dealt with at Letterkenny District Court.

A COUPLE had the Probation Act applied when their case was dealt with at Letterkenny District Court.

Sean White (24), 75 Gleann Tain Manor, Carnamuggagh, Letterkenny, and Chloe Wolstenholme (26), 3 Forte Apartments, Letterkenny, were before the court on Monday.

They were charged with being intoxicated in a public place and threatening and abusive behaviour following an incident on Lower Main Street, Letterkenny, on January 25 of this year.

Sergeant Jim Collins told the court how on the day in question, gardaí were attempting to arrest White when his girlfriend tried to interfere with gardaí.

He said that both defendants were “aggressive to gardaí” and had to be arrested. “When they sobered up they were both apologetic,” said Sergeant Collins. Neither party has any previous convictions, the court was told.

Solicitor Patsy Gallagher represented both defendants. He told the court that on the night in question White had been the victim of an assault.

“All parties accept they were extremely drunk and they were very apologetic.”

Mr Gallagher told the court that an early plea was entered as early as possible.

Judge Emile Daly applied the Probation Act to both White and Wolstenholme. She also directed they both make a charitable contribution of €300 to charity. The contribution is to be paid by May 25. If not, the pair will be convicted and fined €450.
