A Donegal man who stole a fire extinguisher from a Letterkenny casino and began spraying foam over the building also faces charges of defecating in a Garda cell and van.

Leo Marley appeared before Judge Ciaran Liddy at Letterkenny District Court.

Marley, a 35-year-old of no fixed abode, was released on conditional bail having been in custody since the end of July.

Marley has been charged in connection with incidents at Majestic Casino, Ramelton Road, Letterkenny, on July 29, 2026.

He was charged with stealing a fire extinguisher valued at €150. He was also charged with spraying foam from the fire extinguisher over the facade of the building and the walls.

Marley also faces two criminal damage charges from that date, one where he was alleged to have urinated on a cell door and the other where he damaged a wall with faeces. He also faces a similar charge relating to damage caused to a Garda van and cell by defecating and urinating on July 30, 2026 at Main Street, Glenties.

Marley is charged with two assaults, one on Upper Main Street, Letterkenny and one on Oliver Plunkett Road, Letterkenny, on July 29.

He faces two charges of using threatening, abusive or insulting words or behaviour, contrary to section 6 of the Criminal Justice (Public Order) Act, 1994, relating to incidents on Port Road, Letterkenny, and Lower Main Street, Letterkenny.

Marley has also been charged with failing to comply with the direction of a member of An Garda Siochana at Port Road, Letterkenny.

The court was told that the Director of Public Prosecutions (DPP) has directed summary disposal in the District Court.

Marley’s solicitor, Mr Patsy Gallagher, said that his client elected to have the matters dealt with in the District Court and that he would be pleading guilty.

An independent surety of €300 was lodged by a woman, who was present in court while Marley’s own bond of €100 was also lodged.

He was also ordered to reside at a specified address as part of his bail conditions.

Mr Gallagher said that Marley has had addiction and mental health issues. He said that his client has been in custody for three weeks and had started initial counselling while in custody.

Judge Liddy ordered the preparation of a probation report, to include an assessment as to Marley’s suitability for community service. He also asked that victim impact statements be canvassed.

Sergeant Doyle sought permission to re-enter the matter should Marley come to the attention of Gardai and this was granted.
