A Portsalon man charge with causing criminal damage to a neighbour’ property earlier this summer has been given the benefit of the Probation Act.

Joe Callaghan was before the court charged with an incident at Murrin, Portsalon, Fanad on June 13, 2026.

The 65-year-old, also of Murrin, Portsalon, Fanad, was charged with unlawfully damaging property, a window panel of a rear door belonging to another man. The charge is contrary to section 2 (1) of the Criminal Damage Act, 1991.

Previously, Callaghan was brought before a court sitting on the day of the alleged offence when a €500 cash lodgement was put forward and the accused was granted bail.

That was on condition that he stay away from the property of the injured party and that he not communicate, either directly or indirectly, with the injured party.

The case was again before Letterkenny District Court, where Judge Ciaran Liddy applied section 1 (1) of the Probation of Offenders Act, 1907, meaning the defendant avoids a conviction.
